TERMS & CONDITIONS

Machine Repairs, Servicing, Used & Refurbished Machinery

Last updated: [Insert date]

These Terms & Conditions apply to all repair work, servicing, maintenance, sales of used machinery and sales of refurbished machinery supplied by [Business Name], referred to throughout these terms as "we", "us" or "our".

By requesting a repair, booking a service, purchasing machinery or otherwise placing an order with us, you ("the customer", "you" or "your") agree to the applicable terms set out below.

These terms apply to both private individuals and business customers. Where different legal rights apply to consumer and business transactions, those rights will take precedence over any conflicting provision in these terms.

PART 1 – GENERAL TERMS

1. General information

1.1. We provide machinery repairs, servicing, maintenance, fault diagnosis, refurbishment and the sale of new, used and refurbished machinery.

1.2. All work and sales are subject to availability, the nature and condition of the machinery, and any specific quotation or agreement provided to the customer.

1.3. We reserve the right to refuse repair work or a sale where we reasonably consider that the machine is unsafe, unsuitable for repair, uneconomical to repair, or beyond our capabilities.

1.4. Any specific written quotation, order confirmation or agreement provided to the customer will form part of the contract.

1.5. Nothing in these terms is intended to remove, restrict or override any statutory rights that customers have under applicable UK law.

2. Quotations and pricing

2.1. All quotations are based on the information available at the time of assessment.

2.2. Quotations will normally specify the anticipated labour, parts, materials and any additional charges required to complete the agreed work.

2.3. A quotation is valid for the period stated on the quotation. Where no validity period is specified, we reserve the right to review the quotation if circumstances, parts availability or supplier pricing materially change before acceptance.

2.4. If additional faults, damage or necessary work are discovered during the repair, we will contact the customer and obtain approval before undertaking work outside the agreed scope.

2.5. Estimates are not guaranteed final prices. The final cost may change where additional work is authorised or where the original estimate was expressly subject to further investigation.

2.6. All prices will be clearly communicated, including whether VAT is applicable.

2.7. We reserve the right to correct genuine pricing or administrative errors before a contract is confirmed. If an error is identified after an order has been accepted, we will contact the customer to agree an appropriate resolution.

3. Payments and deposits

3.1. Payment terms will be confirmed at the time of quotation, booking or purchase.

3.2. We may require a deposit or advance payment before ordering parts, commencing work or reserving machinery.

3.3. Deposits will be applied towards the agreed total cost. Any refund or deduction on cancellation will be dealt with in accordance with the applicable contract and statutory rights.

3.4. Unless otherwise agreed in writing, the outstanding balance for repair work is payable before the machine is released for collection.

3.5. For machinery purchases, payment must be received in accordance with the agreed payment terms before delivery or collection.

3.6. We accept the payment methods advertised or agreed at the time of purchase.

3.7. Where payment is overdue, we reserve the right to pursue recovery of outstanding amounts in accordance with applicable law. Business customers may also be liable for statutory interest and recovery costs where the Late Payment of Commercial Debts legislation applies.

3.8. Any right to retain machinery pending payment will only be exercised where legally permitted.

PART 2 – REPAIRS AND SERVICING

4. Booking and machine acceptance

4.1. When a machine is delivered to us for repair, servicing or assessment, the customer is responsible for providing accurate information about the machine, its history and the reported fault.

4.2. The customer should disclose any known defects, previous repair attempts, modifications, safety concerns or operating issues.

4.3. We will record the machine's identifying details, including make, model and serial number where available.

4.4. Any accessories, attachments, batteries, chargers or other items supplied with the machine should be identified at the time of booking.

4.5. We recommend that customers remove any personal belongings, valuable items or unrelated accessories before leaving machinery with us.

4.6. We will take reasonable care of machinery and accessories entrusted to us while they are in our possession.

5. Fault diagnosis and assessment

5.1. An initial assessment may be required to identify the reported fault and determine whether a repair is possible.

5.2. Diagnostic work may involve dismantling, testing, inspection or operating the machine where reasonably necessary and safe.

5.3. A diagnostic or assessment fee may apply. Any applicable charge will be communicated to the customer before chargeable assessment work begins.

5.4. An initial diagnosis may not identify every fault. Additional defects may only become apparent once the machine has been dismantled, tested or repaired.

5.5. We will inform the customer of any additional work or costs identified and seek approval before proceeding beyond the agreed repair.

5.6. Where a machine is found to be beyond economical repair, unsafe or unsuitable for repair, we will explain our findings to the customer.

5.7. If the customer decides not to proceed with a repair after an assessment, any agreed diagnostic, dismantling, reassembly or other authorised charges will remain payable.

6. Repair work and authorisation

6.1. Repair work will be carried out with reasonable care and skill.

6.2. We will endeavour to complete repairs within a reasonable timeframe, taking into account the nature of the fault, availability of parts, supplier delays and the complexity of the work.

6.3. Any completion dates or turnaround times provided are estimates unless expressly confirmed as guaranteed in writing.

6.4. We will not undertake additional chargeable work outside the agreed scope without obtaining the customer's approval, except where an alternative has been expressly agreed.

6.5. Where a repair requires specialist parts or components, we may need to obtain these from manufacturers or third-party suppliers.

6.6. We cannot guarantee the availability of discontinued, obsolete or manufacturer-specific parts.

6.7. Where suitable replacement parts are unavailable, we will discuss alternative repair options with the customer where reasonably possible.

7. Repair warranty – 90 days

7.1. We provide a 90-day warranty on repair work carried out by us, commencing from the date the repair is completed and the customer is notified that the machine is ready for collection.

7.2. The repair warranty covers defects in workmanship directly related to the repair undertaken by us and defects in parts supplied and fitted by us, subject to the applicable terms of any manufacturer's warranty.

7.3. If a customer believes that a fault covered by this warranty has developed, they must contact us as soon as reasonably possible and provide details of the problem.

7.4. We may request that the machine be returned to our premises for inspection and assessment before determining whether the issue is covered by the repair warranty.

7.5. Where a fault is confirmed to be covered by the repair warranty, we will arrange an appropriate remedy in accordance with the warranty and the customer's statutory rights.

7.6. The repair warranty does not automatically cover:

  • New faults unrelated to the original repair.

  • Normal wear and tear or deterioration through ordinary use.

  • Consumable items, including blades, belts, filters, oils, seals and similar components, unless specifically covered by the repair agreement.

  • Damage caused by misuse, neglect, incorrect operation or failure to follow operating instructions.

  • Damage caused by accidents, impact, water ingress, fire or other external events.

  • Damage caused by unauthorised repairs, modifications or interference by another person.

  • Faults arising from pre-existing defects that were not part of the original repair.

  • Failures resulting from continued operation after warning signs, abnormal noises, overheating or other indications of a problem.

  • Damage caused by incorrect maintenance or the use of unsuitable fuel, lubricants, batteries, chargers or other consumables.

7.7. These exclusions apply only where relevant to the fault being claimed and do not exclude liability where the law does not permit it.

7.8. The 90-day repair warranty is additional to, and does not replace or restrict, any statutory rights the customer may have.

7.9. The 90-day repair warranty applies to the specific repair work carried out and does not constitute a general warranty for the entire machine or all of its components.

8. Machines that cannot be repaired

8.1. Occasionally, a machine may be found to be beyond economical repair, unsafe or unsuitable for further work.

8.2. We will explain the reasons to the customer and, where appropriate, provide an estimate for any alternative work.

8.3. If the customer declines the proposed repair, they will be responsible for any diagnostic or other charges previously agreed.

8.4. Where a machine has been dismantled for assessment, reassembly may incur an additional charge if this has been disclosed and agreed.

8.5. We will not intentionally return machinery in an unsafe condition without informing the customer of the identified safety concerns.

9. Testing and collection readiness

9.1. Following repair, machinery will be tested where reasonably practical and appropriate to the nature of the repair.

9.2. The extent of testing will depend on the machine type, operating conditions, available facilities and the work carried out.

9.3. A successful test does not guarantee that unrelated or intermittent faults will not subsequently develop.

9.4. Where a machine cannot be fully tested under normal operating conditions, we will advise the customer where reasonably possible.

9.5. The customer is responsible for ensuring that the machine is suitable for its intended use and is operated in accordance with the manufacturer's instructions and applicable safety requirements.

PART 3 – COLLECTION AND UNCOLLECTED MACHINERY

10. Collection of completed repairs

10.1. Customers are required to collect completed machinery within 14 working days of being notified that the repair or service is complete and the machine is ready for collection.

10.2. For the purposes of these terms, working days are Monday to Friday, excluding public and bank holidays in England and Wales.

10.3. Notification may be made by telephone, email, text message or written correspondence using the contact details supplied by the customer.

10.4. It is the customer's responsibility to ensure that their contact details are accurate and up to date and that they respond to collection notifications.

10.5. Customers who anticipate difficulty collecting within the 14-working-day period should contact us as soon as possible to discuss alternative arrangements.

10.6. Collection is subject to any outstanding payment being settled, where payment before release has been agreed and is legally permissible.

11. Storage charges for late collection

11.1. Machinery left with us beyond the initial 14-working-day collection period may incur a storage charge of £20.00 per calendar day, commencing on the day immediately following the expiry of the 14-working-day collection period.

11.2. This charge is intended to cover the additional storage, handling, administration and space occupied by uncollected machinery.

11.3. The storage charge will be communicated clearly to the customer before the repair is authorised or the relevant storage arrangement is agreed.

11.4. The charge will apply for each calendar day, including weekends and public holidays, subject to the charge being properly agreed and legally enforceable.

11.5. Where applicable, the customer will be advised of any outstanding storage charges when contacted about collection.

11.6. Storage charges will be applied fairly and proportionately and only to the extent that they are contractually agreed and legally enforceable.

11.7. We reserve the right to review storage arrangements where exceptional circumstances arise, including delays caused by us or circumstances outside the customer's reasonable control.

12. Machinery left uncollected for six months

12.1. Where a completed repair remains uncollected for a period of six months after the customer has been notified that the machine is ready for collection, we will begin our formal uncollected-goods procedure.

12.2. We will send a written final collection notice to the customer's last known postal address and, where available, email address.

12.3. This notice will provide the customer with a further seven days from the date of the notice to contact us and arrange collection of the machine.

12.4. The final notice will identify the machine, confirm where it is being stored, state any applicable outstanding charges and explain the action that may be taken if the machine remains uncollected.

12.5. If the customer fails to respond or collect the machine following the final notice, we reserve the right to take appropriate legal steps to recover possession, deal with or dispose of the uncollected goods, where permitted by applicable law.

12.6. Any sale or disposal of uncollected machinery will be undertaken in accordance with the applicable legal requirements, including any further notices, waiting periods or procedures required by law.

12.7. The expiry of the additional seven-day period does not, by itself, transfer ownership of the machine to us or automatically authorise disposal.

12.8. Where a sale of uncollected goods is legally permitted, any proceeds and deductions will be dealt with in accordance with applicable law.

12.9. Customers are strongly encouraged to keep their contact details up to date and to contact us promptly if they are unable to collect their machinery.

PART 4 – USED AND REFURBISHED MACHINERY SALES

13. Description of used and refurbished machinery

13.1. We may offer machinery for sale in new, used, refurbished or reconditioned condition.

13.2. Each machine will be described according to its actual condition and the information available to us at the time of sale.

13.3. Used and refurbished machinery may show signs of previous use, including cosmetic marks, scratches, discolouration, wear or other imperfections.

13.4. Photographs and descriptions are intended to provide a fair representation of the machinery. Minor variations in appearance may occur.

13.5. Customers are encouraged to inspect machinery before purchase, particularly where it is being sold as used equipment.

13.6. Any significant known faults, defects, limitations or missing components will be disclosed in the product description or brought to the customer's attention before purchase.

13.7. Any specific defect expressly disclosed and agreed before purchase will be considered when determining the condition of the machine. This does not remove any statutory rights relating to other faults or undisclosed defects.

14. Used machinery

14.1. Used machinery is sold in its described condition, taking into account its age, previous use, condition, price and any disclosed defects.

14.2. Customers acknowledge that used machinery may exhibit signs of wear consistent with its age and previous operation.

14.3. Unless expressly stated otherwise, used machinery may not include original packaging, manuals, accessories or additional components supplied with a new machine.

14.4. The exact accessories, attachments and components included in the sale will be those identified in the product listing, quotation or sales agreement.

14.5. Customers should ensure that the machine is suitable for their intended application before purchase.

14.6. We do not represent that used machinery is equivalent to new machinery unless expressly stated.

14.7. Nothing in this section excludes the customer's statutory rights concerning satisfactory quality, fitness for purpose or conformity with description.

15. Refurbished machinery

15.1. Refurbished machinery has undergone inspection, servicing, repair or replacement of selected components before being offered for sale.

15.2. The level of refurbishment may differ between machines depending on their original condition and the work required.

15.3. Refurbishment may include, where appropriate:

  • Cleaning and general preparation.

  • Mechanical inspection.

  • Electrical inspection and testing.

  • Replacement of selected worn or defective components.

  • Repair or replacement of identified faulty parts.

  • Functional testing.

  • Cosmetic improvement.

15.4. Not every component will necessarily be replaced or restored to new condition.

15.5. Unless expressly stated in the product description, refurbishment does not mean that every part of the machine has been replaced, renewed or restored to manufacturer-new specification.

15.6. Any remaining wear, cosmetic imperfections or limitations known to us will be disclosed where relevant.

15.7. Refurbished machinery will be described according to the actual work carried out and its condition at the time of sale.

16. Warranty on used and refurbished machinery

16.1. Any additional warranty offered with used or refurbished machinery will be expressly stated in the relevant product listing, quotation, invoice or sales agreement.

16.2. The warranty period, scope and applicable conditions will be those specifically communicated for the individual machine.

16.3. Where a machine is sold with a separate written warranty, that warranty will apply alongside the customer's statutory rights.

16.4. Any additional warranty may cover specified mechanical or electrical components and may exclude consumables, normal wear and tear, misuse, accidental damage or unauthorised modifications, provided such exclusions are lawful and fairly applied.

16.5. A warranty does not remove or reduce the customer's rights where machinery does not conform to the contract.

16.6. A machine being described as used or refurbished does not remove the customer's statutory rights under applicable consumer legislation.

17. Inspection before purchase

17.1. Customers are welcome to request further information or arrange an inspection of machinery where this is offered.

17.2. Where customers inspect machinery before purchase, they should raise any questions or concerns about its condition, operation, accessories or suitability before completing the purchase.

17.3. Any specific defects or limitations identified during an inspection and expressly agreed as part of the sale will be recorded where appropriate.

17.4. Customers purchasing remotely should carefully review the product description, photographs and any additional information provided.

17.5. If further information is required, customers should contact us before placing an order.

18. Suitability and safe operation

18.1. Customers are responsible for ensuring that purchased machinery is suitable for its intended application and operating environment.

18.2. Machinery must be used in accordance with the manufacturer's operating instructions and applicable health and safety requirements.

18.3. Where appropriate, machinery should be inspected and maintained by a competent person before being placed into regular operation.

18.4. Customers must not use machinery that they know or reasonably suspect to be unsafe.

18.5. We cannot accept responsibility for damage resulting from operation outside the machine's intended purpose, misuse, incorrect installation or failure to follow operating instructions, except where liability cannot legally be excluded.

PART 5 – ORDERS, DELIVERY AND RETURNS

19. Orders and availability

19.1. All machinery and parts offered for sale are subject to availability.

19.2. Product listings, quotations and advertised prices are provided in good faith and are subject to confirmation.

19.3. An order will be accepted when we confirm acceptance to the customer, unless the order process expressly states otherwise.

19.4. If an item becomes unavailable after an order has been placed, we will contact the customer to discuss the available options, including an appropriate refund where necessary.

19.5. We reserve the right to decline an order where there is a genuine reason, including pricing errors, stock inaccuracies or suspected fraudulent activity.

20. Delivery and collection of purchased machinery

20.1. Delivery arrangements and charges will be agreed at the time of purchase.

20.2. Delivery times are estimates unless a specific delivery date has been expressly guaranteed.

20.3. Customers must ensure that the delivery address is accessible and suitable for the size and weight of the machinery.

20.4. Customers must inform us of any access restrictions, unloading requirements or special delivery arrangements before dispatch.

20.5. Where delivery cannot be completed because the customer has provided incorrect information or failed to make suitable arrangements, additional reasonable delivery or handling costs may apply where agreed and legally permissible.

20.6. Customers collecting machinery are responsible for ensuring that suitable transport, loading equipment and securing arrangements are available.

20.7. Risk in goods supplied to consumers passes in accordance with applicable consumer law. For business sales, risk will pass at the point specified in the agreed sales contract.

21. Returns and cancellations

21.1. Our returns policy operates alongside, and does not replace, the customer's statutory rights.

21.2. Consumers purchasing goods online, by telephone or through other distance-selling arrangements generally have a statutory 14-day cancellation period, subject to the applicable legal exceptions.

21.3. Where the right to cancel applies, customers must notify us within the applicable cancellation period.

21.4. Goods must be returned in accordance with the applicable cancellation requirements. Customers may be responsible for direct return costs where they have been properly informed of this before purchase.

21.5. Consumers may handle goods as they reasonably would in a shop to establish their nature, characteristics and functioning. Deductions may be permitted where handling goes beyond what is necessary and results in diminished value, in accordance with the law.

21.6. Different rules may apply to goods collected in person or purchased at our premises. However, statutory rights relating to faulty or misdescribed goods continue to apply.

21.7. Where machinery is faulty, not as described or otherwise fails to meet applicable legal requirements, customers may have rights to reject, repair, replacement, price reduction or refund depending on the circumstances and the applicable legislation.

21.8. Nothing in these terms prevents a customer from exercising a statutory right to cancel, reject or obtain a remedy where applicable.

21.9. Where repair or servicing work has been commissioned, cancellation and charges will be dealt with in accordance with the agreed contract and any applicable statutory cancellation rights.

22. Part exchanges and trade-ins

22.1. Where we agree to accept machinery as part payment or trade-in, the value will be agreed before the transaction is completed.

22.2. Customers must provide accurate information about the machine's condition, ownership, faults, history and any outstanding finance or third-party interests.

22.3. We reserve the right to revise or withdraw a trade-in offer if the machine's condition materially differs from the information originally provided, subject to the terms agreed with the customer.

22.4. Customers confirm that they are legally entitled to sell or transfer the machinery to us.

PART 6 – CUSTOMER RESPONSIBILITIES AND LIABILITY

23. Customer responsibilities

23.1. Customers must provide accurate contact information and keep us informed of any changes.

23.2. Customers must provide accurate information about machine faults, previous repairs, modifications and operating history.

23.3. Customers are responsible for ensuring that machinery is transported to and from our premises safely and securely, unless transportation has been expressly arranged by us.

23.4. Customers should remove personal belongings and any unrelated accessories before leaving machinery with us.

23.5. Customers must not knowingly supply machinery that is contaminated, hazardous or unsafe without informing us beforehand.

23.6. Where a machine contains electronic data, stored settings, security codes or other information, customers should take appropriate backups and provide any necessary access information required for authorised testing.

24. Liability and limitations

24.1. We will exercise reasonable care and skill when carrying out repairs, servicing, assessments and other agreed work.

24.2. We will take reasonable care of machinery while it is in our possession.

24.3. We will not be responsible for pre-existing defects, hidden damage or unrelated mechanical or electrical failures that were not caused by our work.

24.4. We will not be liable for faults arising from the customer's misuse, neglect, incorrect operation, unauthorised modifications or failure to follow maintenance instructions, except where the law provides otherwise.

24.5. We will not be liable for indirect or consequential losses where such liability may lawfully be excluded or limited.

24.6. Nothing in these terms excludes or limits liability for:

  • Death or personal injury caused by negligence.

  • Fraud or fraudulent misrepresentation.

  • Any liability that cannot legally be excluded or restricted.

  • A consumer's statutory rights.

  • Any other liability which applicable law does not permit us to exclude or limit.

24.7. Business customers should ensure that machinery is inspected, maintained and operated by suitably trained and competent personnel.

24.8. Where machinery is supplied for commercial or professional use, customers are responsible for ensuring compliance with relevant workplace safety and operational requirements.

25. Events outside our control

25.1. We will not be responsible for delays or failures caused by circumstances reasonably beyond our control.

25.2. Such circumstances may include supplier delays, discontinued parts, transport disruption, severe weather, fire, flooding, industrial action, power failures or other unforeseen events.

25.3. Where such circumstances affect a repair, order or delivery, we will endeavour to inform the customer and provide an updated estimate or suitable alternative where possible.

25.4. This section does not remove any statutory rights the customer may have.

PART 7 – GENERAL LEGAL PROVISIONS

26. Complaints and disputes

26.1. We aim to provide a professional and reliable service and welcome feedback from customers.

26.2. If a customer is dissatisfied with a repair, service or purchase, they should contact us as soon as possible, providing their name, order or job reference and details of the issue.

26.3. We will investigate complaints and endeavour to resolve them fairly and promptly.

26.4. Where a complaint concerns a repair, we may request an opportunity to inspect the machine and assess the reported problem.

26.5. Customers should not arrange third-party repairs for a suspected warranty issue without first contacting us, except where immediate action is reasonably necessary for safety or to prevent further damage.

26.6. This does not prevent customers from exercising any statutory rights or taking reasonable steps where urgent action is required.

27. Privacy and personal information

27.1. We collect and use customer information for purposes including processing orders, arranging repairs, communicating with customers, providing quotations, handling payments and fulfilling our legal obligations.

27.2. Personal information will be handled in accordance with our Privacy Policy and applicable UK data protection legislation.

27.3. We will not sell customers' personal information to third parties.

27.4. Information may be shared with relevant service providers where necessary to fulfil an order, arrange delivery, process payment or provide an agreed service.

27.5. Customers can refer to our Privacy Policy for further information about how their personal information is collected, stored and used.

28. Changes to these terms

28.1. We reserve the right to update these Terms & Conditions from time to time.

28.2. The version applicable to a particular repair, service or purchase will generally be the version agreed when the relevant contract was entered into, unless a change is subsequently agreed or required by law.

28.3. Updated terms will be published on our website with a revised update date.

29. Severability

29.1. If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

29.2. Any invalid or unenforceable provision will be interpreted or modified to the minimum extent necessary to make it lawful and enforceable, where legally possible.

30. Governing law and jurisdiction

30.1. These Terms & Conditions are governed by the laws of England and Wales.

30.2. Any disputes will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory legal rights that apply to consumers in other parts of the United Kingdom.
